Notes on the use of the website

Use of this website offered by JBW GmbH (hereinafter referred to as the "Provider") is permitted exclusively on the basis of the following conditions. For the purchase of products and/or services, other terms of use may apply in addition or in substitution. By accepting the use of this website, the validity of these terms of use in their respective version is accepted.

  1. The content published on this website is carefully compiled and reflects the provider's product offer. When selecting products, it is the responsibility of the user to make the selection carefully, considering the data sheets applicable to the product. The provider expressly points out that the user should carry out the necessary validation as his own obligation, if the selected products are suitable for proper use in the user-intended application.

  2. The content published on this website is protected by copyright or special ancillary copyrights. Any use of this content requires the prior written consent of the provider or respective rights holder, unless it is permitted by a mandatory legal regulation. This applies in particular to the duplication, editing, translation, storage, processing or reproduction of content in databases or other electronic media and systems. Third-party content and rights are identified as such. The unauthorized reproduction or distribution of individual content or complete pages or the entire website is not permitted and is sanctioned as criminal in intent. Furthermore, the contents of this website may not be distributed, rented or otherwise made available to third parties by the user at any time. This includes the reproduction of this website (in whole or in part) in the context of framing (in particular "iframe"). Only the production of electronic copies and downloads for personal, private and non-commercial use is permitted, whereby personal use does not include use for publication, e.g. in social networks.

  3. If you as a user (whether commercial or private) are unsure what use you may make of the content of this website, please contact us at info@elektromotore.eu. If you require our permission for use, we will check whether we can or wish to grant such permission and will notify you accordingly. However, the provider is under no obligation to grant such permission.

  4. The website may contain licensed third-party content and/or hyperlinks to entire or individual third-party websites. The provider is only responsible for its own content on these pages in accordance with general legislation, but accepts no responsibility for the content of third parties or the content of the linked websites, nor does the provider adopt these websites and their content as its own. Linked pages were checked for possible legal violations at the time of linking; no legal violations were recognizable at the time of linking. The provider is not obliged to monitor transmitted or stored third-party information or to check for illegal activities, hyperlinks or content. However, permanent monitoring of the content of linked pages is not reasonable without concrete evidence of an infringement. The use of third-party content is therefore at the user's own risk. If we become aware of any legal infringements via notifications or in any other way, or if we are obliged to remove or block the use of information in accordance with general legislation, we will remove this content and/or links immediately.

  5. The provider complies with all laws regulating collection of personal data, security and protection of personal data as well as legal privacy policies regarding use and processing of personal data of the user of this website.

  6. The liability of the provider in the context of the use of this website is excluded, unless the claims are based on an injury that

    - is based on intent or gross negligence of the provider, including intent or gross negligence of the representatives or vicarious agents of the provider, or
    - injury to life, body or health,
    - the assumption of a quality guarantee,
    - the fraudulent concealment of a defect or
    - a violation of the Product Liability Act.

Insofar as the provider or its representatives or vicarious agents are not accused of intentional breach of contract, the liability for damages is limited to the foreseeable, typically occurring damage.

  7. For the purchase of products and/or services, the general terms and conditions of delivery for products and services of the electrical industry ("Grüne Lieferbedingungen", as of January 2018, recommended by ZVEI Zentralverband Elektrotechnik- und Elektronikindustrie e.V.) apply with priority.

  8. The law and the laws of the Federal Republic of Germany shall apply, with the exception of the conflict of laws and the UN Convention on Contracts for the International Sale of Goods. Munich is agreed as the place of jurisdiction if the customer is an entrepreneur within the meaning of Section 14 of the German Civil Code (BGB), a legal entity under public law or a special fund under public law.
